National Environmental Management: Air Quality Act 39 of 2004 Regulations prescribing the atmospheric emission license processing fee

The Minister of Environmental Affairs published regulations prescribing the atmospheric emission license processing fee in terms of Government Notice No. 250 of 11 March 2016 in GG 39805.

Applicants must pay the pre-scribed processing fees before or on the date of the submission of the application or as directed by the licensing authority. Applicants must attach proof of payment to the application form submitted to the licensing authority.

In the instance where an application is refused or the application is withdrawn, the fee will not be refunded.

The prescribed fees are as follows:

New Applications: R 10 000 (per listed activity)

License Review: R 10 000 (per listed activity)

License Renewal: R 5 000 (per listed activity)

Transfer of License: R 2 000

RECOMMENDED ACTION:

All applicable processing fees must be paid before an Atmospheric Emission License will be processed, renewed, reviewed or transferred. [Source:  Legricon specialized Services]

Waste Classification & Management Regulations (2013) and Industry Waste Management Forum

The Waste Classification and Management Regulations, and associated Norms and Standards for Assessment and Disposal of Waste to Landfill (GN R. 634-636), will come into full effect on Tuesday, 23 August 2016, when all transitional arrangements that had been provided for will terminate.

More about the Regulations and Standards:

  • The Regulations and Standards prescribe a revised system for the hazard classification of waste in terms of the Globally Harmonised System of Classification and Labelling of Chemicals (SANS 10234 – GHS), as well as a separate assessment procedure for waste disposal to landfill.
  • These new procedures will replace the Minimum Requirements of 1998 as it relates to waste classification, disposal and landfill designs; and

The Standards include an extensive list of waste disposal restrictions that would come into effect over time, thereby diverting waste from landfills. [Source – IWMSA]
